General Terms and Conditions (GTC)

Scope of application
These General Terms and Conditions (GTC) apply to all contracts for the rental use of vacation homes and apartments offered via the Apartments Westpfalz website. The apartments are located in various places in the West Palatinate. The operator of the website and contractual partner is W&K Immobilienverwaltung GmbH, Bahnhofstraße 3, 67059 Ludwigshafen.

Conclusion of contract and contractual partners
The contractual partners are W&K Immobilienverwaltung GmbH and the guest. The contract is concluded upon acceptance of the guest’s application (e.g. booking via website, e-mail, telephone).

Services, prices, payment, offsetting
W&K Immobilienverwaltung GmbH undertakes to keep the apartments booked by the Guest available and to provide the agreed services. The guest is obliged to pay the applicable or agreed prices for the room rental and the other services used by him. As a rule, the total price is to be paid before arrival.

Withdrawal of the guest (cancellation) / non-utilization of services (no-show)
Cancellations of bookings made directly via our website, by email, telephone or in person can be cancelled free of charge up to [60 days before arrival]. Thereafter, a cancellation fee of [100%] of the total price will be charged. In the event of a no-show without cancelation, the full amount is due. For bookings made via third party providers such as Booking.com, HRS etc., the cancellation conditions of the respective provider apply.

Check-in and check-out
Check-in takes place via a key safe system, which gives guests the opportunity to collect the key to their accommodation at any time. Check-out is required by 11:00 a.m. on the day of departure to ensure a smooth handover and cleaning of the accommodation.

Withdrawal of the accommodation
The accommodation is entitled to withdraw from the contract for objectively justified reasons, in particular if force majeure or other circumstances for which W&K Immobilienverwaltung GmbH is not responsible make it impossible to fulfill the contract.

Room provision, handover and return
The apartments are available to the guest from 15:00 on the agreed day of arrival. On the agreed day of departure, the accommodation must be vacated and returned by 11:00 a.m. at the latest.

Liability of the accommodation
W&K Immobilienverwaltung GmbH is liable for its obligations under the rental agreement with the due diligence of a private accommodation. The accommodation is only liable for damage that is not part of the accommodation service in the event of intent or gross negligence.

Data protection
The guest’s personal data will be treated in accordance with the applicable data protection regulations. Further details on data protection can be found in our privacy policy.

Choice of law
The law of the Federal Republic of Germany shall apply exclusively to all disputes arising from or in connection with the rental agreement. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. For consumers who do not conclude the contract for professional or commercial purposes and have their habitual residence in another country, the mandatory provisions of that country remain unaffected by this choice of law.

Place of jurisdiction
The place of jurisdiction for all disputes arising from or in connection with the rental contract is, as far as legally permissible, the registered office of W&K Immobilienverwaltung GmbH. If the guest does not have a general place of jurisdiction in Germany or in another EU member state, or if the place of residence or habitual abode is unknown at the time the action is filed, the exclusive place of jurisdiction for all disputes shall be the registered office of W&K Immobilienverwaltung GmbH.

Final provisions
Amendments or additions to the contract, the acceptance of applications or these terms and conditions must be made in writing. Unilateral amendments or additions by the guest are invalid.
